Enforce Your Right To Compensation

This also applies even though you have not received a recall notice in most cases in the Baltic States or Finland. In these countries, the car manufacturers solve the problem with voluntary service measures in which the software update is to be installed. But even without a recall notice from the Federal Motor Transport Authority, a claim for damages is possible.

The software update does not solve your problem.

If the manufacturer has written to you and asked you to have a software update carried out in a workshop, this is generally not recommended from a technical point of view. Many drivers have already had negative experiences with the update. There are reports of increased fuel consumption, AdBlue consumption, reduced performance and engine sooting. In addition, the software updates in some cases contain new inadmissible defeat devices. The long-term consequences of the update are difficult to assess and could possibly have a negative impact on the life expectancy of the vehicle. 

Action for damages in German courts

It is possible for you to enforce the claim for damages before German courts. This is particularly advantageous because, in contrast to other European countries, German courts have had to deal with tens of thousands of claims for damages in connection with Dieselgate and have generally ruled in favor of consumers.

Return of the vehicle and refund of the purchase price

If your claim for damages is successful, you return your vehicle to the manufacturer and receive a refund of the purchase price paid. You will have to deduct a compensation for the mileage you have already driven from the purchase price. In view of the loss in value, though, you are regularly better off even after this deduction than you would be if you sold the car.
