Dieselgate: Make Things Right

In September 2015, following previous investigations by the U.S. environmental authorities, Volkswagen admitted to having installed illegal defeat devices in its Diesel engines. These defeat devices deceived the responsible approval authorities and buyers and contributed to the fact that millions of cars are registered on our roads that do not comply with environmental protection regulations, thereby harming our environment and our fellow human beings on a large scale. 

In the USA, the Volkswagen-Group has already had to pay more than 16 billion euros as part of disputes and settlements, in which they also admitted that they had defrauded customers. Recently several other manufacturers have also been found to use illegal defeat devices in the cars, vans and other vehicles they produced, including Opel, Daimler Benz, BMW, Fiat and Nissan.

In Europe, however, the major automakers have shied away from comparably generous compensation and confessions. Instead, customers often continue to be deceived or reassured with illegal solutions ("software updates"), a campaign that has been particularly successful in smaller countries such as Estonia, Lithuania and Latvia.

Nevertheless, or precisely because of this, the manufacturers affected by Dieselgate have been hit by a major wave of lawsuits. In Germany alone, more than 60,000 claims for damages have been filed with civil courts. On the basis of these lawsuits and through the involvement of the European Court of Justice, reliable court practice has already developed both at EU level and at national level in Germany, which generally awards damages to purchasers. This established legal practice also makes it easier for Estonian, Finnish, Latvian and Lithuanian plaintiffs to enforce their rights before German courts.
