A new BMW model has been identified with illegal defeat devices

The German Federal Motor Transport Authority (KBA) has found that the two BMW X3 EURO 5 models – BMW X3 xDrive20d and X3 sDrive 18d with N47D20 engine – have unauthorised defeat devices. The exhaust gas recirculation is reduced when the air conditioning is switched on and at certain outside temperatures, which is illegal according to judgements of the European Court of Justice. These measures result in an unacceptable reduction in the effectiveness of pollutant reduction for NOX rates. Around 33,000 vehicles are affected in Germany.

Although this decision of KBA is not yet legally valid, owners of BMW X3 2,0l models can still seek their rights of a fair compensation from BMW.

It is clear that illegal defeat devices are part of the climate change problem. Consumers can lawfully pressure large car manufacturers to compensate their harm to the climate.
