Defeat devices used by Volkswagen are illegal

Shortly before the expected ruling of the European Court of Justice regarding Dieselgate on 21 March 2023, the Administrative Court of Schleswig-Holstein (Germany) has issued another landmark decision:

Defeat devices used by Volkswagen are illegal (ref. 3 A 113/18).

German Environmental Aid (DUH) had filed a lawsuit against the Federal Motor Transport Authority of Germany (KBA) because it had granted type approvals for affected VW models.

The ruling has far-reaching consequences: millions of diesel vehicles would become potentially illegal on the roads in Europe, as the type approval will have to be canceled.

The affected vehicles would either have to be retrofitted or decommissioned.

This would not only affect VW models, but also the models of almost all other manufacturers, such as Mercedes-Benz, BMW or Porsche.
