Mercedes sentenced to pay compensation by Stuttgart High Court

Damages awarded for the use of illegal defeat devices:

Many diesel vehicles of the prestigious German car manufacturer are still affected.

In its decision 23 U 55/21, the Stuttgart High Court found Mercedes Benz Group AG liable for dieselgate-related damages, even though the affected car had been sold during the course of the legal proceedings before the judgement was handed down. The ruling underlines that it is possible to hold car manufacturers accountable for their involvement in the emissions cheating scandal and signals a victory for affected consumers seeking compensation.

The court awarded damages equivalent to 10% of the purchase price, citing findings that the Mercedes vehicle in question, a GLK 220 CDI, used illegal defeat devices, including a thermal window and coolant temperature control (KSR).

The decision also reflects a wider trend among German courts, which are increasingly ruling in favour of compensation for individuals affected by Dieselgate. These rulings mark a pivotal moment in the quest for justice for affected car owners.

As the legal landscape continues to evolve, affected consumers are encouraged to pursue their rights through the courts to seek compensation for the damage caused by Dieselgate. The judgments are a reminder of the power of the judiciary to hold companies to account for their actions.
